Other Factors That Affect the Cost of a Speeding Ticket

Unfortunately, calculating the cost of a speeding ticket isn’t as simple as knowing the base fines and additional fees. How much you pay can also be influenced by:

Whether It’s a First or Subsequent Offence

The chart above shows the potential fine for a first-time speeding ticket. But if you are caught speeding again within a certain timeframe, penalties increase. Let’s take a look:

Speeding at 1-26+ MPH over the limit

First offense: Base fine of up to $100
Second offense within one year: Base fine of up to $200
Third offense within one year: Base fine of up to $250

Speeding at More than 100 MPH:

First offense: Base fine of up to $500, 30-day license suspension
Second offense within three years: Base fine of up to $750, six-month license suspension
Third offense within five years: Base fine of up to $1,000, one-year license suspension

Where You Were Caught

Certain zones have higher base fines for speeding because there is more safety risk. Let’s take a look:

Speeding in a Construction Zone

Typically, base fines are at least double in construction zones, although this can vary by jurisdiction. In general, you’ll see base fines like:

1–15 mph over the limit: $70
16–25 mph over the limit: $140
26+ mph over the limit: $100

These result in a total ticket cost of between $376 and $650+.

Speeding in a School Zone

The speed limit in a school zone is typically 25 mph within 500 to 1,000 feet of a school when children are outside or crossing the street. Some areas may have limits as low as 15 mph. In California school zones, base fines will look something like this:

1-15 mph over the limit: $99 base fine
16-25 mph over the limit: $175 base fine
26 mph or more over the limit: $350 base fine

Safety Enhancement Double Fine Zones

These are specific highway segments designated as special zones due to high accident rates. Fines for offenses like speeding, reckless driving, and DUI are doubled in these areas.

Senior Center Zones

A “senior zone” refers to an area approaching or passing a senior center or other facility used primarily by senior citizens. Unlike in school zones, the slower speed limit is in place all day. Base speeding fines in senior zones will look something like this:

1 to 15 mph over the limit: $99 base fine
16 to 25 mph over the limit: $175 base fine
26 mph or more over the limit: $350 base fine

Business Districts and Railroad Crossings

Specific amounts vary depending on the speed and local ordinances, but base fines in these areas are typically higher than in other areas.

Note: The maximum base fine for a speeding ticket in California is $1,000, but California adds mandatory state and county surcharges to every traffic fine, which can multiply the base fine by 4 to 5 times. There’s no official statewide “maximum total fine” because the added fees vary by county and court.

Speeding Tickets and Points on Your License

California uses a DMV point system to track and penalize unsafe driving behavior by assigning points to your driving record for traffic violations. Each violation adds a set number of points. Accumulating too many points within a specific time frame can lead to consequences like license suspension and higher insurance premiums. Most speeding tickets are 1-point violations, although a few more serious violations result in 2 points.

Type of Speeding Violation	Vehicle Code	DMV Points
Basic speeding (unsafe speed under 100 mph)	CVC 22350	1 point
Exceeding 65 mph speed limit	CVC 22349(a)	1 point
Exceeding 55 mph two-lane highway limit	CVC 22349(b)	1 point
Exceeding posted 70 mph limit	CVC 22356	1 point
Exceeding 100 mph	CVC 22348(b)	2 points
Reckless driving (if charged separately)	CVC 23103	2 points

You’ll have your license suspended for six months if you accumulate:

4 points within 12 months
6 points within 24 months
8 points within 36 months

How Long a Speeding Ticket Stays on Your Record

In California, a speeding ticket stays on your driving record for 3 to 7 years depending on the type of ticket you received.

Most basic speeding violations under California Vehicle Code 22350 or 22356 stay on your DMV driving record for 3 years from the violation date. Each conviction adds 1 point to your record but, after 3 years, the point automatically drops off your public record and insurance companies typically stop counting it.

A conviction for driving over 100 mph adds 2 points to your record. That conviction stays visible for 7 years. Courts can also impose a 30-day license suspension for a first offense.

In general, insurers usually look back 3-5 years for moving violations. Most one-point speeding violations are eligible for traffic school, which keeps the point off your record altogether.

Speeding Tickets and Your Car Insurance

Fines aren’t the only cost you need to calculate when you get a speeding ticket. Speeding tickets can also drive up your insurance rate. Here’s how speeding tickets can affect your average monthly premiums:

Traffic Violation	Average Monthly Premium
None	$183
Speeding 6 to 10 mph over the limit	$260
Speeding 11 to 15 mph over the limit	$259
Speeding 16 to 20 mph over the limit	$230
Speeding 21 to 25 mph over the limit	$259
Speeding in a school zone	$260

As long as you are eligible, you can attend traffic school for a speeding ticket. This will mask the point from your license, preventing an increase in your insurance rates.

What to Do When You Get a Speeding Ticket in California?

If you get a speeding ticket, your options include:

1. Pay the Fine

By paying the fine, you admit guilt and the violation is recorded on your driving record. This may lead to increased insurance premiums.

2. Attend Traffic School

Completing traffic school can prevent the violation from appearing on your public driving record and help you avoid insurance rate hikes. Note that you still need to pay the fine – as well as an administrative fee – to attend traffic school. If traffic school is an option, it will say so on your ticket. You can also try to request it if it doesn’t appear as an option. You will be eligible for traffic school if you:

Plead guilty to the traffic violation
Have not taken traffic school in the last 18 months
Have been cited for a minor (1-point) moving violation

3. Contest the Ticket

If you believe the ticket isn’t merited, you can opt to contest it. You can do this by court trial, where you will plead not guilty and present any evidence you have to the court. You can also do this without a trial by using a trial by written declaration. If you’re contesting your ticket, you may want to consider getting the help of an attorney.

4. Ignore the Ticket

A lot of people try this one – but it isn’t recommended! Failing to address the ticket can lead to additional penalties, including increased fines, a civil assessment of up to $100, a charge of “Failure to Appear,” and potential suspension of your driver’s license.

When You Should Fight a Speeding Ticket

Fight a ticket when the money or license risk is higher than the time and effort it takes to contest it. This might be the case if it’s a serious violation (like going over 100 mph), you already have points, or you have solid evidence the ticket might be wrong. The checklist below helps you decide when it’s worth challenging and what steps to take.

Consider fighting your speeding ticket if:

The ticket is for >100 mph (2 points, not traffic-school eligible).
You already have prior violations and another conviction could trigger license suspension.
The ticket will likely result in your insurance rate jumping significantly
You believe the officer’s evidence is weak (bad sightline, no radar log, inconsistent timing, no calibration, no supporting photos).
You were not the driver (but were listed) or there’s a strong identification issue.
You were cited in a construction, school, or special zone where fines are doubled (the total cost is high.)
The citation contains errors (wrong vehicle, wrong location, incorrect statute) that may make it dismissible.

When paying the ticket (and going to traffic school!) is the better choice:

It’s a minor first offense (small speed over the limit) and you’re eligible for traffic school.
You live far from the court and don’t want to take time off work (although you could try a trial by written declaration.)
You value convenience and want to get it all over with quickly.

FAQs About Speeding Ticket Costs in California

How long does a speeding ticket stay on your license in California?

In California, a speeding ticket can stay on your license for between three and 10 years. Single-point violations like red light camera tickets, cell phone violations, and basic speeding tickets stay on your license for up to three years. But more serious violations, like speeding over 100 mph, engaging in speed contests, or reckless driving can stay on your license for up to 10 years. This is how the DMV point system in California works.

How to get a speeding ticket dismissed in California?

Getting a ticket dismissed means having it removed from your record – as though it never occurred. This can be done by contesting the ticket and winning. This typically happens when a convicted driver has evidence to prove that the ticket is incorrect. In rare cases, dismissal can also happen if the ticket can be proved to be inaccurate, such as the make of the car or license plate having been entered incorrectly. While attending traffic school won’t get your ticket dismissed, it does mask the point from your license. This prevents your insurance from going up.

Is it worth fighting a speeding ticket in California?

Sometimes, yes, it is. If you fight a ticket, you are pleading not guilty, which means you need evidence that you don’t deserve the speeding ticket. If there is some extenuating circumstance, like you were rushing an injured friend to the hospital, you may have a case. If you have nothing in the way of a defense, you may be disappointed by the outcome in court.

Some people also go to court in the hope that the officer who wrote the ticket won’t show up and the case will be dismissed. This does happen, but there is no guarantee. If you go to court and lose, you can still request traffic school. But going to court is time consuming (and can also be expensive if you work with a lawyer.) It’s best for more serious tickets or when you’re at risk of license suspension. If your record is clean and your insurance rates are low, the potential savings may not outweigh the effort.

What speed is considered reckless driving in California?

In California, there isn’t a specific speed that automatically counts as “reckless driving.”
Instead, it depends on how you were driving.

Under California Vehicle Code 23103, reckless driving is defined as:

“A person who drives a vehicle upon a highway in willful or wanton disregard for the safety of persons or property is guilty of reckless driving.”

That means that the state must prove that you knowingly drove in a way that endangered others—not just that you were speeding.

That said, certain speeds almost always trigger a reckless driving charge. This includes going over 100 mph, engaging in any kind of racing, or going 20-30 mph over the limit in dense traffic or near others.
